Consumer Health Data Privacy Policy

This policy describes how MBN Care Solutions, LLC ("MBN," "we") handles consumer health data as defined by the Washington My Health My Data Act, and the rights of Washington consumers. It is separate from, and supplements, our general Privacy Policy. Note that health information we process as a HIPAA business associate under a Business Associate Agreement, or that is governed by Washington's health-care information law (chapter 70.02 RCW), may be exempt from the Act; this policy applies to consumer health data that is not so exempt.

Categories of consumer health data we collect, and why

  • Information related to the care of residents entered by adult family homes (for example, conditions, medications, and care documentation), collected to provide the care-management Service to the home.
  • Account and contact information associated with a consumer, collected to operate the Service and respond to requests.

Categories of sources

  • Directly from the adult family home (our customer) and its authorized staff, who enter the data.
  • From the consumer or their representative, where provided.

Categories of consumer health data we share

We share consumer health data only as necessary to provide the Service — for example, with our cloud hosting provider — and as required by law. We do not share consumer health data with advertisers or data brokers, and we do not sell consumer health data.

Categories of third parties and affiliates we share with

  • Amazon Web Services — cloud hosting and storage, under a business associate agreement.
  • Payment processor — billing only; does not receive resident health data.
  • Government authorities — only when legally required.

Your rights under RCW 19.373.040

If you are a Washington consumer, you have the right to:

  • Confirm and access whether we collect, share, or sell your consumer health data, and access that data;
  • Obtain a list of third parties and affiliates with whom we have shared or sold your consumer health data;
  • Withdraw consent to our collection and sharing of your consumer health data;
  • Delete your consumer health data, including from backups and archives, and we will direct our processors and any third parties to delete it; and
  • Appeal a denial of a request. If we deny your appeal, you may contact the Washington Attorney General at atg.wa.gov/file-complaint.

Consent

We collect and share consumer health data only for the purposes disclosed here. We obtain any consent required by RCW 19.373.030 before collecting or sharing consumer health data for other purposes, and a separate authorization before any sale (we do not sell consumer health data). We do not use geofencing around health-care facilities.

How to exercise your rights

Email [email protected]. We will authenticate your request and respond within 45 days (extendable once by 45 days with notice), consistent with the Act.
